Article 2: Purpose
These Terms of Sale define the rights and obligations of both the customer and FIG'S regarding the purchase of jewelry and accessories, including personalized or custom orders, offered on the figseshop.com website.
These Terms of Sale also apply to any order placed with FIG'S outside of the figseshop.com website, including orders made by email, phone, or in-person quotes.
Any purchase made on figseshop.com or any order placed with FIG'S implies full and binding acceptance of these Terms of Sale. By checking the acceptance box before finalizing an order or by signing a quote with FIG'S, the customer confirms that they have read and accepted these Terms of Sale.
These Terms of Sale are permanently available on figseshop.com, so that customers and potential customers can consult them prior to placing an order.
FIG'S reserves the right to modify all or part of the Terms of Sale at any time. The Terms of Sale applicable to an order are those in force at the date and time the order is validated.
Article 3: Prices
The prices listed on figseshop.com are in € (euros) and exclusive of tax, as FIG'S is currently not subject to VAT. Prices displayed are those in effect at the time the order is placed. If FIG'S becomes subject to VAT, prices displayed will include the applicable VAT.
For orders outside the EU, the customer is responsible for local taxes, customs duties, or import fees.
FIG'S reserves the right to modify prices due to changes in material costs or other factors. However, the price applicable to the customer is the one displayed at the time the order is placed.
Prices include packaging costs but do not include delivery charges, which are added at checkout and vary depending on the destination and the carrier. FIG'S may occasionally offer free shipping under specific conditions.
From time to time, FIG'S may offer promotions. In such cases, the original price will be crossed out and the promotional price displayed, subject to stock availability. After the promotion ends, prices revert to their original value.
Discounts may be available under specific conditions. Customers must apply the corresponding discount code at checkout. Promotions and discount codes cannot be combined unless explicitly stated.
Article 4: Orders
1. Placing an Order
Standard Orders (via figseshop.com):
Customers can place an order via figseshop.com, subject to stock availability. Orders are considered final only upon confirmation by FIG’S.
Custom Orders (personalized or made-to-measure jewelry):
Customers may request a custom order by agreeing on a design with FIG’S, signing a quote, and paying a 50% deposit. Custom orders are considered final once the quote is signed and the deposit is received. Non-payment of the 50% deposit voids the custom order, and production will not commence until the deposit is received. The remaining balance must be paid in full before the item is shipped. Shipment will only take place once the balance has been fully paid.
2. Account and Customer Information
To place an order, the customer provides personal information (name, email, address). The customer is responsible for ensuring the accuracy of this information. FIG’S may suspend or cancel orders with incorrect or incomplete information.
3. Payment
Orders are payable via the methods indicated at checkout. FIG’S reserves the right to refuse any order for legal or payment reasons.
4. Delivery
Orders are delivered to the customer’s address or, in some cases, a local pick-up point. Delivery dates are indicative, and FIG’S is not liable for delays beyond its control. Customers must check parcels upon receipt and report any damage immediately. Uncollected parcels may be returned; in such cases, refunds exclude shipping costs.
5. Custom/Bespoke Orders
Custom or personalized orders (made-to-measure jewelry) are non-returnable. FIG’S provides sketches and technical details for validation. Items are manufactured according to the approved design, chosen materials, and technical specifications, with a tolerance of 0.5 mm. FIG’S is not liable for damage due to improper use. Manufacturing defects will be repaired or replaced at FIG’S discretion.
6. Liability
FIG’S is not liable for indirect or consequential damages, loss of profits, or misuse of products.
7. Cancellation and Account Deletion
FIG’S reserves the right to cancel orders or delete accounts in cases of fraud, malicious intent, or undeliverable locations.
8. Contact
For questions or complaints, customers may contact FIG’S via the contact form on figseshop.com or email contact@figseshop.com. Competent courts in France will have jurisdiction for any disputes.
Article 5: Payments
1. General Payment Methods
The customer can complete their order using the payment methods offered through Shopify, PayPal, or Alma, which may include split payments. If a desired payment method is unavailable, the customer may contact FIG’S to explore alternative solutions, without guarantee that an alternative solution will be available.
2. Payment Confirmation & Customer Responsibility
The customer confirms they are authorized to use the selected payment method and agrees to ensure the smooth processing of the order. FIG’S reserves the right to refuse any order:

Not validated by the chosen payment provider,

Not fully paid, or
-
Placed by a customer currently in a payment dispute with FIG’S.
If the customer does not receive an order confirmation email, the payment may not have been validated. It is the customer’s responsibility to contact FIG’S to resolve the issue. FIG’S is not responsible for payment refusals by banks or payment providers.
The invoice is manually issued by FIG’S and will be sent by email after the order has been processed. Customers should note that it is not automatically generated at the time of order confirmation. Once payment is validated, the customer will receive the invoice.
3. Personalized / Custom Orders
For personalized or made-to-measure jewelry not available on figseshop.com, payment is preferably made by bank transfer. Exceptionally, a payment link via Stripe may be offered; in this case, Stripe is responsible for processing the customer’s financial data.
4. Deposit & Balance for Custom Orders
For personalized or made-to-measure jewelry (custom orders), a deposit of 50% of the total amount must be paid before raw materials are purchased. The remaining balance is due upon completion of production. Custom orders are only produced after receipt of the deposit and are non-returnable, in accordance with Article L.221-28 of the French Consumer Code.
The remaining balance must be paid in full before the item is shipped. Shipment will only take place once the balance has been fully paid. FIG’S reserves the right to adjust the percentage of the deposit required for high-value orders, in which case the remaining balance will also be due before shipment.
Article 6: Rights of withdrawal
1. Non-Returnable Items
Bespoke or personalized items (such as rings, stacking rings, bracelets, stamped jewelry, and custom orders) are non-returnable. Therefore, the customer does not have a right of withdrawal for these products, in accordance with Article L.221-28 of the French Consumer Code.
2. Returnable Items
For all other items (such as pendants or earrings), excluding made-to-measure items, the customer has 14 days from receipt to return them, in accordance with Article L.121-21 of the French Consumer Code. To initiate a return, please contact FIG’S at contact@figseshop.com within this period to receive instructions. Refunds or exchanges will be processed once the returned items are received and inspected, minus the original shipping costs.
3. Condition of Returned Items
Returned items must be unused, undamaged, and complete. They must be returned in their original packaging or in protective packaging sufficient to allow resale.
Boxes and pouches are considered an integral part of the order. The right of withdrawal cannot be exercised for items damaged due to improper handling by the customer.
4. Reporting Defects or Damage
Customers must inspect items upon receipt. Any damage or major manufacturing defect must be reported to FIG’S within 7 days of delivery, either via email at contact@figseshop.com or using the contact form on figseshop.com. For defective or damaged items, FIG’S will provide guidance on repair, replacement, or refund.
5. Return Shipping
Return costs are the responsibility of the customer and must be shipped at their own risk. FIG’S recommends using a trackable shipping method. FIG’S is not responsible for items lost during return transit. Customers should notify FIG’S promptly when returning items. For defective items, return shipping costs will be covered by FIG’S.
6. Refunds and Exchanges
Refunds exclude original shipping costs, as well as any additional fees incurred due to failed or delayed deliveries. Refunds will be made using the same payment method used for the order. Exchanges are possible for returnable items, please contact FIG’S at contact@figseshop.com to arrange the exchange.
Article 7: Delivery
1. Delivery Scope & Excluded Destinations
FIG’S delivers worldwide. However, due to geopolitical or environmental conditions, some destinations are currently undeliverable, including: Haiti; Crimea; Sevastopol; Belarus; Russia; North Korea; Syria; Yemen; and Somalia.
Other destinations may experience delays or disruptions for similar reasons. FIG’S temporarily does not ship to the United States due to new tax and customs regulations.
2. Shipping Costs & Carriers
Shipping costs vary depending on the delivery destination. Unless otherwise agreed, FIG’S uses Delivengo for Europe (excluding France), Colissimo for all other destinations.
Colissimo may also be used for European orders requiring additional insurance. Tracking is available via Laposte.fr, and once the parcel arrives in the destination country, the same tracking number can be used with the local postal service.
3. Transfer of Risk
Ownership and risk of loss are transferred to the customer upon shipment.
4. Dispatch Times & Delivery Estimates

Orders from figseshop.com are dispatched within 10 days.

Custom/personalized orders have specific shipping dates provided by FIG’S.

Delivery times generally range from 3 to 15 days. FIG’S is not responsible for delays beyond its control but will assist with the carrier to resolve issues.
5. Delays & Unavailability
A delayed delivery does not necessarily indicate a lost parcel; it may be held at a transit point or affected by geopolitical or environmental issues. In rare cases, items may become unavailable. In such cases, FIG’S will contact the customer to agree on either extended delivery or a refund.
6. Customer Responsibilities & Address Accuracy
Customers must provide complete and accurate delivery information. FIG’S is not responsible for delivery issues caused by incomplete or incorrect addresses. If a parcel is returned due to an address issue, the customer will be refunded minus shipping costs.
7. Pick-Up Points
Parcels are usually delivered to the customer’s address. For certain destinations, customers may choose pick-up point delivery (e.g., via Mondial Relay). If the customer selects this delivery method, FIG’S will send an email prompting the customer to choose the pick-up point closest to their address from a list given by FIG'S.
The parcel cannot be dispatched until the customer provides this information. Customers must also collect the parcel within 7–14 days, depending on the carrier. Failure to provide the pick-up point details or to collect the parcel may result in no refund. If the parcel is returned to FIG’S, a refund will be issued minus shipping costs.
Pick-up point shipments (e.g., via Mondial Relay) are at the customer’s risk until collected. Delivery dates are indicative and not guaranteed.
Article 8: Guarantee
1. Legal Guarantee
FIG’S guarantees that items sold comply with the sales contract. Customers may invoke the legal guarantee of conformity, in accordance with Articles L.217-4 to L.217-7 of the French Consumer Code, within 2 years from the date of delivery. Remedies include repair, replacement, or refund to the original payment method.
2. Conformity Criteria
An item is considered in conformity if it:

Matches the description, type, quantity, and quality, including functionality, compatibility, interoperability, or other characteristics specified in the contract;

Is suitable for any special use communicated to FIG’S at the time of purchase and accepted by FIG’S;

Is delivered with all accessories and instructions provided in accordance with the contract.
A lack of conformity detected within 24 months of delivery is presumed to have existed at the time of delivery, unless proven otherwise.
3. Defects and Reporting
FIG’S ensures items are carefully packed for transport. FIG’S is not responsible for damage caused during shipment by carriers or third parties. Customers should inspect parcels upon receipt and report any damage immediately to the carrier used for delivery.
If the customer detects a major defect resulting from the manufacturing process (e.g., broken components, missing parts, significant flaws), they must notify FIG’S promptly by email or via the contact form, within 7 days of receiving the item. FIG’S will then provide instructions to process the claim under the legal guarantee of conformity.
4. Handmade & Natural Stone Variations
All FIG’S jewelry is handmade. Slight variations between the delivered item and website images are normal and inherent to handmade production. Stones such as moonstone, larimar, and labradorite are naturally unique; colors, patterns, and inclusions may vary slightly from images. FIG’S ensures that overall colors are close to those shown online, and stones that do not match essential color characteristics (e.g., non-blue labradorites or moonstones) will not be shipped.
Article 9: Responsibility
1. Force Majeure and Third-Party Events
FIG’S is not responsible for breaches of contract caused by uncontrollable and unforeseeable events, including third-party services (such as carriers) or the customer.
2. Misuse of Products
FIG’S is not responsible for any consequences, damages, or accidents resulting from misuse of the products offered on figseshop.com (e.g., ingestion, strangulation, or improper handling).
3. Allergic Reactions and Material Safety
FIG’S is not responsible for allergic reactions or other physical issues caused by the jewelry. The materials used in each item are detailed on figseshop.com, and customers are responsible for reviewing them before purchase.
The total liability of FIG’S for any claim related to an order is limited to the total amount paid by the customer for that order. This liability cap applies to all claims related to the contract, including defects, delivery issues, or misuse of products, and covers both standard and custom orders.
Article 10: Intellectual property
All texts, images, photographs, and other content presented on figseshop.com are protected by copyright and intellectual property laws. Any use or reproduction of this content is strictly prohibited, including for personal or non-commercial purposes, unless the author has expressly granted permission.
Requests for permission to use FIG’S content must be submitted in writing to contact@figseshop.com. Consent must be expressly granted by the content owner before use.
Website Reproduction
Any total or partial reproduction of the figseshop.com website is strictly prohibited and may constitute a violation of copyright laws.
Credits:
Media (photos and videos) are shared between Abigail Van Kooten and Manon Figari, with each being the author of specific images.
Some images from the Yggdrasil collection are credited to Sofia Vide Alenbrand.
The FIG'S company logo is protected and owned by Paul Figari, who has authorized its use by FIG'S.
Legal Enforcement
Any unauthorized use of FIG’S content may result in legal action.
Article 11: Personal data
1. Data Collection & Purpose
When placing an order, users must provide personal data (surname, first name, email, postal address, and phone number). This data is collected to ensure smooth order processing, including quotes, invoices, payment, delivery, and order updates. It may also be shared with delivery service providers (e.g., La Poste, Mondial Relay) solely for the purpose of shipping the order. Data is not used for other purposes or sold to third parties.
All personal data is stored on the figseshop.com website, hosted by the SHOPIFY platform, in compliance with applicable data protection regulations (including GDPR).
Order-related data is retained for the duration required by accounting and legal obligations (up to 10 years in France). Newsletter data is kept until the user unsubscribes.
2. Newsletter Subscription
With prior consent, the user’s name and email may be used to send a newsletter with updates or promotional codes. Subscription requires explicit consent by checking the box stating: "I confirm that I have read and agree to the privacy policy regarding the use of my personal data."
A link to the full privacy policy is provided just below the subscription form for reference.
Subscribers may unsubscribe from the newsletter at any time by clicking the ‘unsubscribe’ link included in each email.
3. Payment Data
For standard orders placed on figseshop.com, online payments are securely processed via SHOPIFY, PAYPAL, or ALMA, depending on the user’s choice. FIG’S does not store financial data, which is handled exclusively by the payment providers responsible for data protection.
For custom orders (i.e., personalized jewelry not available on figseshop.com), payment is made via bank transfer or, exceptionally, via a payment link processed by STRIPE. In this case, STRIPE is solely responsible for handling and protecting the customer’s financial data.
4. Cookies
Users are invited to accept cookies, which facilitate navigation (e.g., saving the shopping basket). Acceptance is optional. Users can accept or refuse cookies via the dialog box displayed upon visiting figseshop.com.
5. Customer Rights
Users may access, rectify, request portability or request deletion of their personal data. Requests should be sent via the contact form on figseshop.com or by email at contact@figseshop.com
If users believe their rights are not respected, they may file a complaint with the CNIL (Commission Nationale de l’Informatique et des Libertés).
Article 12: Force majeure
Orders not yet dispatched may be suspended in the event of force majeure, including, but not limited to: natural disasters, war or armed conflict, riots or civil disturbances, strikes or transport route blockages, any unforeseeable event beyond the control of the parties that prevents proper execution of the contract.
FIG’S and the customer must remain in contact to determine the future of the order, including whether it will be postponed, modified, or canceled.
FIG’S cannot be held liable for any delays, suspensions, or non-fulfillment of orders caused by force majeure events.
The customer cannot claim damages or compensation for suspension, delay, or non-fulfillment of orders caused by a force majeure event.
Article 13: Applicable laws and competent jurisdictions
DISPUTE – CONSUMER MEDIATION
In the event of a dispute between the Customer and the company, they will endeavor to resolve it amicably (the Customer will send a written complaint to the professional or, where applicable, to the Customer Relations Department of the professional). In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Consumer Customer within the meaning of Article L.133-4 of the Consumer Code has the possibility of enter free of charge, if a disagreement remains, the competent mediator registered on the list of mediators drawn up by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the Consumer Code, to know :

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The invalid provision will be interpreted or replaced to the extent necessary to reflect the parties’ original intent and maintain legal validity.
APPENDIX
Consumer Code
Article L. 217-4:
“The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility."
Article L. 217-5:
"The good complies with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted."
Article L. 217-6:
“The seller is not bound by the public declarations of the producer or his representative if it is established that he did not know them and was not legitimately in a position to know them”.
Article L. 217-7: “The defects of conformity which appear within twenty-four months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. For goods sold second-hand, this period is set at six months. The seller can fight this presumption if it is not compatible with the nature of the good or the lack of conformity invoked."
Article L. 217-8:
“The buyer is entitled to demand that the goods conform to the contract. He cannot, however, contest conformity by invoking a defect which he knew or could not ignore when he contracted. The same applies when the defect has its origin in the materials that he himself supplied.”
Article L. 217-9:
“In the event of a lack of conformity, the buyer chooses between repairing and replacing the good. However, the seller may not proceed according to the choice of the buyer if this choice entails a manifestly disproportionate cost with regard to the other method, taking into account the value of the good or the importance of the defect. He is then required to proceed, unless it is impossible, according to the method not chosen by the buyer."
Article L. 217-10:
“If the repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded. The same option is open to him:
1° If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month of the buyer's complaint;
2° Or if this solution cannot be without major inconvenience for him given the nature of the property and the use he is looking for. However, the resolution of the sale cannot be pronounced if the lack of conformity is minor."
Article L. 217-11: "The application of the provisions of articles L. 217-9 and L. 217-10 takes place at no cost to the buyer. These same provisions do not preclude the allocation of damages and interest."
Article L. 217-12:
"The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods."
Article L. 217-13: "The provisions of this section do not deprive the buyer of the right to exercise the action resulting from redhibitory defects as it results from articles 1641 to 1649 of the civil code or any other action of contractual or extra-contractual nature recognized by law."
Article L. 217-14:
"Recourse action may be exercised by the final seller against successive sellers or intermediaries and the producer of the tangible movable property, according to the principles of the Civil Code."
Article L. 217-15 :
"The commercial guarantee means any contractual commitment of a professional towards the consumer with a view to the reimbursement of the purchase price, the replacement or repair of the goods or the provision of any other service in relation with the good, in addition to its legal obligations aimed at guaranteeing the conformity of the good. The commercial guarantee is the subject of a written contract, a copy of which is given to the buyer. The contract specifies the content of the guarantee, the terms of its implementation, its price, its duration, its territorial scope as well as the name and address of the guarantor. In addition, it clearly and precisely mentions that, independently of the commercial guarantee, the seller remains bound of the legal guarantee of conformity lied mentioned in Articles L. 217-4 to L. 217-12 and that relating to defects in the thing sold, under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code. The provisions of Articles L. 217-4, L. 217-5, L. 217-12 and L. 217-16 as well as Article 1641 and the first paragraph of Article 1648 of the Civil Code are reproduced in full in the contract. In the event of non-compliance with these provisions, the warranty remains valid. The buyer is entitled to rely on it."
Article L. 217-16:
"When the buyer asks the seller, during the course of the commercial guarantee granted to him during the acquisition or repair movable property, a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run. This period runs from the purchaser's intervention request or the provision for repair of the good in question, if this provision is subsequent to the request for intervention.
Civil Code
Article 1641:
“The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which diminish this use so much that the buyer would not have not acquired, or would have paid a lesser price for it, if he had known them.”
Article 1648:
"The action resulting from redhibitory defects must be brought by the purchaser, within two years from the discovery of the defect. In the case provided for by article 1642-1, the action must be introduced, on pain of foreclosure, in the year following the date on which the seller can be discharged from the apparent defects or lack of conformity."
